Welcome to YNR Sports Fitness.

YNR Sports Fitness is operated by YNR Sports & Fitness Ltd (“we”, “us”, “our” or “the Company”).

These Terms of Service govern your use of www.ynrsportsfitness.co.uk and your purchase of products or services from us.

Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and services to you.

By visiting, browsing, using our website or purchasing from us, you agree to these Terms of Service together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies referred to in these Terms.

Nothing in these Terms excludes or restricts any statutory rights that cannot lawfully be excluded or restricted.

If you do not agree with these Terms, you should not use the Services.


SECTION 1 - ACCESS AND ACCOUNTS

You must have the legal capacity to enter into a contract to place an order with us.

You agree that information you provide when placing an order or creating an account will be accurate, current and complete.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity carried out through your account where this results from your failure to keep those credentials secure.

You must notify us promptly if you believe your account has been accessed without authorisation.

You may not use our website or Services for any unlawful or fraudulent purpose.


SECTION 2 - OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, photographs, specifications, prices and other information displayed on our website are accurate.

Colours and appearance may vary slightly depending on your screen, device, lighting and display settings.

Measurements and other specifications may be subject to reasonable manufacturing tolerances where appropriate.

We may update product descriptions or specifications and may discontinue products where reasonably necessary.

All products are subject to availability.

Nothing in this section affects your statutory rights. Where you are purchasing as a consumer, goods supplied must comply with the rights and standards required by applicable UK consumer law, including requirements relating to satisfactory quality, fitness for purpose where applicable and conformity with their description.


SECTION 3 - ORDERS, CANCELLATIONS, RETURNS AND REFUNDS

When you submit an order, you are making an offer to purchase the products in that order.

An automated order acknowledgement does not necessarily mean that your order has been accepted.

A contract is formed when we accept your order, normally by confirming the order or dispatching the relevant goods.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

a product is unavailable;
there is an obvious pricing or listing error;
payment cannot be authorised;
we reasonably suspect fraud or misuse;
delivery restrictions apply; or
we are unable lawfully to fulfil the order.

If we cancel an order after payment has been taken, we will refund the relevant payment.

Please check your order carefully before submitting it.

If you are a consumer purchasing goods online, you will normally have a statutory right to cancel your purchase without giving a reason within 14 days after the relevant goods are received, subject to applicable statutory exceptions.

After notifying us of a statutory cancellation, you will normally have a further 14 days to return the goods.

Certain products can be exempt from change-of-mind cancellation rights where permitted by law, including certain goods made to the consumer's specifications or clearly personalised.

These exceptions do not remove statutory rights where goods are faulty, damaged, incorrect or not as described.

Our commercial returns policy may give you additional rights beyond the statutory minimum. We currently provide a 28-day return window for eligible non-faulty products, subject to the conditions stated in our Refund Policy.

Nothing in our Refund Policy or these Terms affects your statutory consumer rights.


SECTION 4 - PRICES, TAXES AND PAYMENT

Product prices may change from time to time.

The price applicable to your order will normally be the price displayed when you submit the order, except in the case of an obvious error.

Applicable taxes, delivery charges and other mandatory charges will be disclosed as required before you complete your purchase.

You agree to provide accurate and complete billing and payment information.

Payment must be authorised using one of the payment methods available at checkout.

We may refuse or cancel a transaction if payment is declined, unauthorised or reasonably suspected to be fraudulent.


SECTION 5 - SHIPPING AND DELIVERY

We aim to dispatch orders in accordance with the delivery information shown on our website and in our Shipping Policy.

Delivery times are estimates unless we expressly agree otherwise.

We are not responsible for delays caused by circumstances outside our reasonable control, such as severe weather, customs processing, disruption to carrier networks or other exceptional events. This does not affect any statutory rights you may have concerning delayed or failed delivery.

Unless a different delivery period has been agreed with you, consumer orders will be delivered within the period required by applicable law.

For consumer purchases, goods remain at our risk until they come into the physical possession of you or a person identified by you to receive them.

If you independently commission a carrier that was not offered by us as a delivery option, risk may pass to you when the goods are delivered to that carrier, as provided by applicable law.

SECTION 6 - INTELLECTUAL PROPERTY

Unless otherwise stated, the content of our website, including text, graphics, photographs, logos, product information, videos, designs and other material, is owned by or licensed to YNR Sports Fitness, YNR Sports & Fitness Ltd or the relevant rights holder.

Such content may be protected by copyright, trade mark, design and other intellectual property laws in the United Kingdom and other applicable jurisdictions.

You may use our website for lawful personal use.

You must not reproduce, distribute, modify, republish, commercially exploit or otherwise use protected content without permission from the relevant rights holder, except where permitted by law.

Shopify's name, logos and other intellectual property belong to Shopify or its licensors.

YNR Sports Fitness is powered by Shopify, which enables us to provide the Services to you.

However, sales and purchases made through our Store are made directly between you and YNR Sports Fitness.

Shopify provides ecommerce technology and related services but is not the seller of products purchased from YNR Sports Fitness.

To the extent permitted by applicable law, Shopify is not responsible for the performance of the sales contract between you and YNR Sports Fitness or for products sold directly by us.

Nothing in this section excludes any rights or remedies that cannot lawfully be excluded.

If you voluntarily provide feedback, suggestions or reviews concerning our products or Services, you grant us permission to use that material for legitimate business purposes, including operating, improving and promoting our products and Services, subject to applicable law.

You confirm that content you submit:

If an error affects an order that has already been submitted, we will act in accordance with applicable contract and consumer law.

Where we cancel an affected order after taking payment, the relevant payment will be refunded.

Services supplied to consumers must also meet applicable statutory requirements, including reasonable care and skill where required by law.

Any additional manufacturer's or commercial warranty is provided in addition to, and not instead of, statutory consumer rights.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing excludes or limits liability for:

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill.

We are not responsible for loss or damage that was not reasonably foreseeable, except where applicable law provides otherwise.

Where you purchase products wholly or mainly for personal purposes, we are not responsible for business losses such as loss of profit, loss of revenue or loss of business opportunity arising from that consumer purchase.

SECTION 18 - BUSINESS USERS AND RESPONSIBILITY

If you use our Services wholly or mainly for business purposes, additional commercial terms may apply.

To the extent permitted by law, business users are responsible for losses resulting from their unlawful use of the Services, infringement of third-party rights or material breach of these Terms.

Nothing in this section imposes an indemnity obligation on a consumer acting wholly or mainly outside their trade, business, craft or profession.

If any provision of these Terms is found by a court or competent authority to be unlawful, invalid or unenforceable, that provision will be treated as modified to the minimum extent necessary or, where modification is not possible, severed from these Terms.

The remaining provisions will continue in effect.

If we delay exercising a right or remedy, this does not necessarily mean that we have waived that right or remedy.

These Terms, together with the policies expressly incorporated into them and the information forming part of your order, constitute the agreement applicable to your use of the Services and relevant purchases.

Nothing in these Terms excludes information or rights that applicable law requires to form part of a consumer contract.

We may transfer our rights or obligations under these Terms where permitted by law, provided that doing so does not reduce your statutory rights.

These Terms of Service and contracts between you and YNR Sports Fitness are governed by the laws of England and Wales.

Nothing in these Terms removes any mandatory consumer protections that apply to you under applicable law.

Nothing in these Terms prevents either party from bringing proceedings before a court that has jurisdiction under applicable law.

If you are a consumer living in another part of the United Kingdom or another jurisdiction that gives you mandatory local consumer protections or jurisdictional rights, those rights are not affected by this section.

Changes to these Terms will not retrospectively alter the contractual terms applicable to an order that has already been accepted, except where required or permitted by law and appropriately agreed or notified.
